§ 18.2-46.2. Prohibited criminal street gang participation; penalty.

A. Any person who actively participates in or is a member of a criminal street gang and who knowingly and willfully participates in any predicate criminal act committed for the benefit of, at the direction of, or in association with any criminal street gang shall be guilty of a Class 5 felony. However, if such participant in or member of a criminal street gang is age eighteen years or older and knows or has reason to know that such criminal street gang also includes a juvenile member or participant, he shall be guilty of a Class 4 felony.

B. Violation of this section shall constitute a separate and distinct offense. If the acts or activities violating this section also violate another provision of law, a prosecution under this section shall not prohibit or bar any prosecution or proceeding under such other provision or the imposition of any penalties provided for thereby.

In the State of Virginia there has to be a predicate act or offense in order for a Gang Participation charge to be assessed

PERJURY

§ 18.2-434. What deemed perjury; punishment and penalty.

If any person to whom an oath is lawfully administered on any occasion willfully swears falsely on such occasion touching any material matter or thing, or if a person falsely make oath that any other person is 18 years of age or older in order to obtain a marriage license for such other person, or if any person in any written declaration, certificate, verification, or statement under penalty of perjury pursuant to § 8.01-4.3 willfully subscribes as true any material matter which he does not believe is true, he is guilty of perjury, punishable as a Class 5 felony. Upon the conviction of any person for perjury, such person thereby shall be adjudged forever incapable of holding any office of honor, profit or trust under the Constitution of Virginia, or of serving as a juror.

We are still not there yet,  on July 10, 2012 the same Corrupt People who tried and failed to prosecute Anjaulyeke Bryant-Covert, her Daughter Belinda Yates and Grandson Antonio Navarro are now targeting another one of her younger grandson’s 19 year old ALEJANDRO Navarro aka Alex for a Felony Perjury charge because he went in front of the grand jury in June of 2011 and said that he had no knowledge of the street gang “Goon Squad” and that he was not a gang member, which is 100% accurate. In Feb of 2012 They charged him with perjury, obtained warrants falsely and went on a Manhunt. Sheriff Deputies geared up as if they were going to arrest a Wanted Murderer who was armed and dangerous and went and surrounded the home of one of the Aunts, they were wearing swat gear, they had weapons drawn and several dogs all around the property in the late hours of the night. (This is all captured on video) Alex was not at the residence at the time. Family members located Alex and escorted him to the Magistrates office to answer the warrant. Deputies then arrested him and held him without bond for weeks. Now with his Grandma exonerated along with his cousin and his aunt how in the hell do they think that they are going to get away with this one? They have screwed up yet again and refuse to accept the facts and  back off.

In my opinion CA Peterson showed his hand before he was ready. Peterson assumed that he would get convictions on the other Family members before Alex’s trial was to be heard and thus the Gang ” Goon Squad ” would exist and justify the actions of the Stafford County Common-Wealth Attorney’s office. Now that this did not happen what is he going to say or do to recreate this fictitious dangerous criminal street gang?

Come July 10, 2012 ALEJANDRO Navarro aka Alex will be the 4th member of this Family to be exonerated on Bogus charges since May 2, 2012. Now with that being said when is enough going to be enough? Stafford County’s CA office has gone above and beyond the scope of Justice in all of the cases here. It is one thing to legitimately have evidence to charge and process a trial when you have people who have committed crimes but it is a whole different monster to go above and beyond the Law to create evidence, perjure yourself and force others to do the same in order to obtain warrants, charges, trials and convictions.

It only leaves one to believe that this Family is not the first Family to experience this type pf Corruption on this level with these people. I was told by a very reliable source that there are many many young Men sitting in jail in Stafford County’s Privately Owned County Detention Facility   Rappahannock Regional Jail

Who are unaware of what Gang they even belong to but are charged and or have been convicted on Gang Charges. These Evil people will take a simple situation such as simple assault, disorderly conduct, etc.. something that would not normally bring any jail time and throw the Gang Statue on top of it and now it becomes a situation that may send you to prison for years. This has been a well oiled machine and has been protocol since the inception of the Regional Gang Task Force. Find groups of people and charge them with Gang Charges, stack the charges so that the Common-Wealth will have room to force you to take a plea deal. If you are being told that they WILL get convicted if you don’t take the plea deal and that you are looking at 10 to 20 years if you don’t take the plea what would you do if you don’t know any better or if you are scared of possibly being sent to prison for years for something that you aren’t guilty of? This has been a common practice and has kept Stafford County’s conviction rate at a steady 98% for years now. This 98% conviction rate is something that the Senior Common-Wealth Attorney Eric Olsen proudly boasts about.

Stafford County and the surrounding 15th District should be investigated, The FBI, Justice Department and Homeland Security should step in and review All of the cases of Gang Participation as well as All of the cases that CA Jim Peterson has Prosecuted and slap Brady Violations on All of the Deputies, Officers and Detectives who knowingly and purposely lied, committed perjury and/or with held evidence in these cases in particular. Once a Brady Cop is outed their credibility is non-existent in a Court of Law. Homeland Security in particular because this is in fact Terrorism on our own soil against our own Citizens and Human Trafficking as a business.

I plan to commit myself along with others who would like to join me in making our presence known thru out the 15th district especially in the Stafford County Courts. I am going to regularly monitor cases specifically gang charges and harsher charges against young Hispanic and Black Males. I  commit myself to Expose The Truths in Any and All Cases where Corruption is evident and not only teach but assist those who have become victim to this Corruption.
